Sendrowski vs Carmignani civil suit settled

Dudley - The case of former Dudley Board of Selectmen Chairman Joseph E. Sendrowski against Dudley Town Treasurer Richard Carmignani was settled Monday, in advance of a jury trial scheduled to begin that day in Worcester Superior Court. The lawsuit charged Mr. Carmignani with defamation of character and intentional infliction of emotional distress.

Mr. Sendrowski said, “This has been a long process fighting for my reputation. The case is settled. There is a confidentiality agreement in place and I cannot discuss the terms of settlement. I will say that I am very happy with the results in this case."

The settlement is the culmination of a series of events that began in 2005 with an affidavit and recall petition signed by five Dudley residents, alleging that Mr. Sendrowski had abused his power as a selectman.

A recall election was held on September 13 of that year. Mr. Sendrowski was recalled, and replaced by Steven Sullivan, who is the current chairman of the board.

In April 2006 Mr. Sendrowski’s attorney Michael V. Caplette of Southbridge filed a civil lawsuit on his behalf against the five people who had filed the affidavit and recall petition, claiming defamation of character.

During the ensuing discovery process it appeared that Mr. Carmignani had also been involved in the preparation of the affidavit, and he was added to the lawsuit. Mr. Sendrowski’s case against the original defendants were either settled or dismissed, and only the case against Mr. Carmignani remained.

Mr. Carmignani did not wish to comment.

Subaru’s “Share The Love” Event helps deliver nutritious meals and compassion to the elderly

Dudley, MA (February 23, 2012) – Tri-Valley’s Meals on Wheels Program is proud to announce it has been awarded a $750 grant from Meals On Wheels Association of America (MOWAA) in recognition of its participation in MOWAA’s “Share The Love” Most Meals Contest.  As part of Subaru of America, Inc.’s “Share The Love” Event, the Meals on Wheels Program worked with Long Subaru of Webster during the holiday season to reach out to the community to encourage volunteerism for the program and publicize services for seniors.

Carol Muschler, Nutrition Program Director, praised Subaru of America’s initiative and said, “We intend to continue our relationship with Long Subaru based on the success of our initial joint venture.”

As one of the five Subaru “Share The Love” Event charitable partners, MOWAA created the Most Meals Contest to foster partnerships between local Meals On Wheels programs and Subaru dealerships. MOWAA is awarding $150,000 in Most Meals grants to the 48 Meals On Wheels programs across the country that recruited dealership employees to volunteer, deliver meals in Subaru vehicles and engage community members in the fight to end senior hunger.

Most Meals grants awarded by MOWAA range from $250 to $35,000.  The nation’s economic downturn has made it more difficult to raise money to provide meals to the community’s homebound seniors.  Tri-Valley’s Meals on Wheels Program will use the monies toward the cost of delivering meals to seniors in the agency’s 25-town service area of south central Massachusetts.

The Subaru “Share The Love” Event ran from November 19, 2011 to January 3, 2012.   Subaru is donating $250 for every new Subaru vehicle sold or leased during “Share The Love” to the customer's choice of one of five charities, including MOWAA. Over the past three years, proceeds from the Subaru “Share The Love” Event have provided funds to MOWAA to support its vision to end senior hunger by 2020.

"We are honored to be part of ‘Share The Love’ again this year," said MOWAA President and CEO, Enid Borden.  "Subaru is a corporation with a conscience. They understand that providing nutritious meals to hungry and homebound seniors in need is a moral imperative."

Tri-Valley is a private, non-profit agency.  The agency receives funding from the Commonwealth of Massachusetts through the Executive Office of elder Affairs and from the Federal government, under the Older American’s Act, processed through the Central Mass Agency on Aging.  Funds are also received from other public and private sources.  All donations are welcome and memorials may be established. For more information about services or volunteer opportunities, please call Tri-Valley at 508-949-6640.

Arrest made; numerous offenses charged

Dudley  Police Report

On Wednesday, February 8, 2012, at approximately 12:30 am, the Dudley Police Department received a call from a motorist reporting he was following a red pick-up truck from the Town of Webster into the Town of Dudley.  The truck was operating on four flat tires.  The truck traveled behind a home in the area of Charlton Rd. and Sawmill Rd.  Dudley Police Sergeant Paul Ceppetelli and Officers Anthony Didonato and Arthur Ferreira responded.

While checking the area, Sergeant Ceppetelli heard the sound of an engine accelerating and decelerating, as well as the sound of tires spinning.  He observed a red pick-up truck against an above ground pool in the back yard of # 40 Charlton Rd.  The truck was later identified as a 2001 Ford F-150, registered to Mark Lindsay, age 34, of Charlton, Ma.  A white male wearing a white short sleeve shirt ran from the drivers side of the vehicle into the woods located behind the residence.  A brief chase ensued and mutual aid assistance, including a K-9 dog, was sought from the Webster Police Department.   Webster Officers Difusco, Larochelle, and Suss responded to assist.  The suspect was not initially located.

As they established a perimeter to contain the suspect, Officer Ferreira observed a white male, matching the driver’s description, hiding behind a large tree in the wooded area near the intersection of Charlton Rd. and Sawmill Rd.  The suspect once again attempted to flee.  After a brief foot pursuit into the wooded area, Officer Ferreira apprehended this individual.  He was identified as Mark J. Lindsay, age 34 of 302D Partridge Hill Road in Charlton.  Mr. Lindsey had a folding knife, keys to the suspect vehicle, and a small amount of marijuana on his person.  He was also suspected to be under the influence of alcohol.  He had some minor injuries to his hand and he was treated by Dudley EMS Personnel.

He was later placed under arrest and transported to the Dudley Police Headquarters.  He charged with numerous offenses, including Driving Under the influence of Alcohol (Second Offense), Negligent Operation of a Motor Vehicle, Leaving the Scene of a Property Damage Accident, Vandalizing Property, Trespassing, Wanton Destruction of Property over $250.00, as well as Possession of a Class D Drug.  Bail was set at $240.00 and he was held for an appearance at Dudley District Court this morning.

In addition to extensive damage to the lawn, driveway, pool, and other property at the residence on Charlton Road, the driver is suspected in connection with numerous reports of damage caused in both Dudley and Webster.  A vehicle, matching the description of the red pick-up, had been observed crashing into numerous structures throughout the Town of Webster.  Gauge marks in the roadway, consistent with a vehicle traveling on its wheels from various scenes in Webster, led to the crash scene in Dudley.  The marks were observed on Main St. and Prospect St. in Webster.  They continued onto Oxford Ave., Pine St., Old Charlton Rd., and Charlton Rd. in Dudley.

Officer Arthur Ferreira suffered some minor injuries during this incident.  He did not require medical attention at that time.  The matter remains under investigation by both the Dudley and Webster Police.

Possible fraudulent local scam

Notice from Dudley Fire Chief
Dean Kochanowski

Posted Feb. 6

Fire Chief Dean Kochanowski would like to inform all Dudley residents of a possible fraudulent fundraising scam. On February 3, 2012 some Dudley residents called the Dudley Fire station stating they had received calls from a person stating to with the Massachusetts Call/Volunteer Firefighters Association and that they were conducting a fundraiser to raise money for local fire departments, specifically the Town of Dudley. Residents were asked to leave money out on their front step or in their front door for pick up tomorrow.

Currently The Dudley Fire Department is conducting no such fundraiser and although the Massachusetts Call/ Volunteer Firefighters is a legitimate organization. They would never conduct a fundraiser in this manner. They would first contact local fire departments and conduct their fundraising efforts through the local departments. Forms would have to be filled out and prior solicitation would have been conducted through the press and via mail, etc.

This is most likely a scam for persons to steal money from local citizens. Do not leave money out for any reason. Should you have any questions, do not hesitate to call the Dudley Fire Department or the Dudley Police Department.

Dudley highway truck damaged in accident

Date: Thursday January 19, 2012

Location: Dresser Hill Road & Northwest Schoolhouse Road, Dudley

Particulars: Two vehicle operators narrowly escaped serious injury in Dudley Thursday morning, as a pick up truck collided with a Dudley Highway Department dump truck towing a wood chipper. The accident occurred at the intersection of Route 31 (Dresser Hill Rd.) and Northwest Schoolhouse Road at approximately 8:30 AM.

A Toyota Tacoma pick up truck was traveling east on NW Schoolhouse Road as it approached the intersection at Dresser Hill Road. Apparently, the driver of the pick up truck failed to stop at the intersection as the Dudley Highway dump truck, with an industrial wood chipper in tow, was proceeding through the intersection northbound on Dresser Hill Road.

The dump truck was hit broad-side and was spun 180 degrees, ending up facing south in the southbound lane. The wood chipper was up-ended and came to rest on its side, still attached to the dump truck. The pick up truck came to rest facing north in the southbound lane of Dresser Hill Road. Both vehicles were heavily damaged.

Dudley Police and Fire departments responded to the scene. The driver of the pick up truck was treated on scene for his injuries by Dudley paramedics and transported to the hospital for evaluation. The driver of the dump truck did not require medical aid. Dudley firefighters assisted Dudley Highway personnel in removing debris from the roadway.

The accident restricted travel on the road to one lane for about 45 minutes. The accident is currently being investigated by the Dudley Police Department.
